GENERAL TERMS AND CONDITIONS OF SALE (GTC) – LYOZE BEAUTY
PREAMBLE
These General Conditions of Sale (hereinafter “GCS”) govern, without restriction or reservation, all sales concluded between:
• The seller: LYOZE Beauty, brand operated by LYOZES, registered with the Paris Trade and Companies Register under number 814 428 785, whose head office is located at 60 rue François 1er, 75008 Paris, France. Contact: contact@lyozebeauty.com – +33 6 84 70 07 02.
• And any natural person who is a consumer within the meaning of the Consumer Code, acting for non-professional purposes (hereinafter “the Customer”), wishing to purchase the products offered on the site www.lyozebeauty.com (hereinafter “the Site”).
Acceptance of these Terms and Conditions implies a waiver of any prior version or contradictory document. The Site is powered by Shopify. Hosting is provided by Shopify (detailed contact details are available in the Site's Legal Notices).
1) PURPOSE AND SCOPE OF APPLICATION
The purpose of the General Terms and Conditions of Sale is to define the rights and obligations of the parties in the context of the online sale of cosmetic products and accessories marketed by LYOZE Beauty to Customers. They apply to all orders placed on the Site, for deliveries in France and, where applicable, internationally depending on the areas served.
2) PRODUCTS
2.1. Characteristics – The products offered are described (composition, format/volume, usage instructions, precautions, etc.) and photographed with the greatest care. Minimal color/visual differences may occur depending on the screens and configurations of the devices.
2.2. Compliance – Cosmetics are placed on the market in accordance with applicable regulations (in particular Regulation (EC) No. 1223/2009). Batches may vary; the ingredient lists appearing at the time of purchase are authoritative.
2.3. Availability – Offers are valid as long as they are visible on the Site, while stocks last. LYOZE Beauty reserves the right to withdraw a product from sale at any time.
3) PRICES, TAXES AND FEES
3.1. Prices – Prices are indicated in euros, inclusive of all taxes (TTC) for sales to the EU (unless otherwise stated), excluding delivery costs. The applicable price is the one displayed at the time of ordering.
3.2. Taxes – Applicable taxes (VAT, duties or fees) depend on the country of delivery and the Customer's status. For deliveries outside the EU, customs duties and import taxes may apply and are the responsibility of the Customer.
3.3. Delivery costs – Calculated automatically at checkout based on the destination and total weight (products + packaging). Any delivery offers are specified on the Site.
3.4. Pricing errors – In the event of an obvious display error (low prices, etc.), LYOZE Beauty reserves the right to cancel the order after informing the Customer and offering a full refund.
4) CUSTOMER ACCOUNT AND INFORMATION
4.1. The Customer can order as a guest or via an account. The Customer undertakes to provide accurate information and to keep it up to date (identity, address, email, telephone number).
4.2. The Customer is responsible for the confidentiality of his/her identifiers; any activity carried out via his/her account is deemed to have been carried out by him/her.
5) ORDER
5.1. Process – Product selection > basket > identification > address and delivery method > payment > confirmation. Before validation, the Customer can check/rectify the details of his order.
5.2. Acceptance – The sale is concluded when LYOZE Beauty confirms acceptance by email (order confirmation). LYOZE Beauty reserves the right to refuse any order for legitimate reasons (previous dispute, suspicion of fraud, abnormal quantities, etc.).
5.3. Modification/Cancellation – Once accepted, the order can no longer be modified online. The Customer can contact customer service; the request will be processed on a best efforts basis, without guarantee.
6) PAYMENT
6.1. Means – Payments are made online via the secure solutions offered at checkout (bank card, wallet, etc.).
6.2. Security – Transactions are encrypted; LYOZE Beauty does not have access to full card data.
6.3. Default of payment – LYOZE Beauty reserves the right to suspend or cancel any order in the event of refusal of authorization by the banking organization or payment incident.
7) RESERVATION OF OWNERSHIP
LYOZE Beauty retains full ownership of the products until full payment of the price (principal and accessories).
8) SHIPPING, DELIVERY AND DEADLINES
8.1. Fulfilment – Logistics execution is handled by a partner (including Selfnamed). For guidance: 1–10 products ~ 2 working days; 11–100 ~ 7 days; 100+ ~ 12 days; 1000+ ~ 30–60 days. These lead times may vary (periods of high demand, stocks, etc.).
8.2. Shipping – Shipping times vary by country and service (standard/express): France ~ 6 working days standard (express 1 day if available); EU ~ 4–7 days; USA ~ 2–5 days standard. Times are indicative.
8.3. Tracking – A confirmation email with a tracking number will be sent when provided by the carrier. Large orders may be shipped in multiple packages.
8.4. Address – The Customer must check the accuracy of their address; in the event of an incomplete/incorrect address, reshipping charges may apply.
8.5. Transfer of risks – For consumer sales, the risk of loss or damage is transferred to the Customer upon physical delivery of the products to the Customer (or to a designated third party), unless the carrier has been chosen by the Customer and not proposed by LYOZE Beauty.
9) RECEIPT, ANOMALIES AND LOST PARCELS
9.1. Upon receipt, the Customer is invited to check the condition of the package and the products. In the event of an anomaly (damaged package, missing/damaged product, preparation error), the Customer must contact customer service within 48 hours with photos.
9.2. Package “delivered” but not received: check with the neighborhood/concierge/relay point; if not found, contact customer service within 7 days with the order number. An investigation is opened with the carrier; depending on the outcome, a resend or refund is offered.
10) RIGHT OF WITHDRAWAL (14 DAYS – EU)
10.1. Time limit – In accordance with the Consumer Code, the Customer has 14 days from receipt to notify their decision to withdraw, without having to provide a reason for their decision.
10.2. Notification – By email to contact@lyozebeauty.com (indicate order number, products concerned). A sample form is included in the Appendix.
10.3. Returns – Products must be returned without undue delay and no later than 14 days after notification, in their original condition: unopened, unused, sealed and in the original packaging, with proof of purchase. For hygiene and safety reasons, opened cosmetics (broken seal) cannot be returned.
10.4. Return costs – Except in the case of a defective product or an error by LYOZE Beauty, return costs are the responsibility of the Customer.
10.5. Refund – In the event of a valid withdrawal, LYOZE Beauty will refund the price paid and standard delivery costs (excluding express options) within 14 days of notification, reserving the right to defer the refund until actual receipt of the products or proof of shipment.
10.6. Exclusions – The following are excluded from the right of withdrawal: unsealed/opened, personalized products, gift cards, as well as promotional items where permitted by law.
11) RETURNS WITHOUT WITHDRAWAL (DEFECTIVE PRODUCT/ERROR)
In case of defective or damaged product upon receipt, or preparation error, contact customer service immediately upon receipt (photos provided). After evaluation, LYOZE Beauty will proceed with an exchange, a return of the missing parts or a full refund, return shipping costs covered.
12) LEGAL GUARANTEES
12.1. Legal guarantee of conformity (2 years) – The Customer benefits from the guarantee of conformity for consumer goods. The goods must comply with the contract and with normal usage. The Customer has a period of two years from delivery to take action. He may demand compliance (repair/replacement) or, failing that, a price reduction or resolution.
12.2. Warranty against hidden defects – The Customer benefits from the warranty against hidden defects (art. 1641 et seq. Civil Code). It is up to the Customer to prove the defect. The action must be brought within the legal time limits.
12.3. These guarantees are exercised at no cost to the Customer and independently of the right of withdrawal.
12.4. Cosmetic consumables are subject to normal conditions of use, storage and DLUO/PAO; normal wear and tear or improper use are not covered by the warranty.
13) RESPONSIBILITY
13.1. LYOZE Beauty cannot be held responsible for non-performance or poor performance due to the Customer, the unforeseeable and insurmountable act of a third party, or in the event of force majeure (see art. 14).
13.2. The information and usage advice provided on the Site are not a substitute for medical advice. LYOZE Beauty declines all responsibility in the event of use of products not in accordance with the instructions/recommendations.
13.3. To the extent permitted by law, indirect damages (loss of opportunity, commercial damage, etc.) are excluded.
14) FORCE MAJEURE
Neither party shall be liable if the performance of its obligations is delayed or prevented due to force majeure within the meaning of Article 1218 of the Civil Code (e.g. strikes, disasters, pandemics, administrative decisions, network outages). Obligations are suspended for the duration of the event.
15) INTELLECTUAL PROPERTY
The trademarks, logos, texts, visuals, photos, videos and more generally all the contents of the Site are protected. Any reproduction, representation, adaptation, unauthorized exploitation is prohibited and may incur the liability of the offender.
16) PERSONAL DATA
The processing of personal data is described in the Privacy Policy available on the Site. It specifies the purposes, legal bases, retention periods, GDPR rights (access, rectification, erasure, opposition, portability), and contact details.
17) CONSUMER MEDIATION – RLL (EU)
17.1. In the event of a dispute, the Customer should first contact customer service (contact@lyozebeauty.com) for an amicable resolution.
17.2. Failing this, the Consumer Customer may have free recourse to a competent consumer mediator or to the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/odr.
17.3. LYOZE Beauty informs the Customer of the existence of this system in accordance with the Consumer Code.
18) APPLICABLE LAW – JURISDICTION
These General Terms and Conditions are governed by French law. Any dispute relating to their formation, validity, interpretation or execution shall be brought before the competent French courts, without prejudice to the mandatory protective provisions applicable to the consumer.

20) PROOF – ARCHIVING
Confirmation emails, logs and transaction records kept by LYOZE Beauty and/or its service providers constitute proof. For any order exceeding €120 including tax, LYOZE Beauty ensures the archiving of the contract for 10 years and guarantees access to it to the Customer upon request, in accordance with Article L.213-1 of the French Consumer Code.
21) MODIFICATION OF THE GTC
LYOZE Beauty reserves the right to amend these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of the order. Previous versions can be provided upon request.
